These Terms of Service govern your access to and use of RumReef.co and any Shopify apps, digital products, downloads, services, websites, software, tools, and related features provided by Rum Reef.
Rum Reef is an independent business operated by Jason Guarino in Oldsmar, Florida, United States.
In these Terms, “Rum Reef,” “we,” “us,” and “our” refer to Rum Reef and Jason Guarino as its operator. “You” and “your” refer to the person or business accessing or using our website, apps, products, or services.
By visiting RumReef.co, purchasing a product or service, installing or using a Rum Reef Shopify app, creating an account, or otherwise using our services, you agree to these Terms.
If you do not agree to these Terms, do not purchase, install, access, or use the applicable product or service.
1. Eligibility and Authority
You must be at least 18 years old or the age of legal majority where you live, whichever is higher, to use our services.
If you install an app, make a purchase, or accept these Terms on behalf of a business or another organization, you represent that:
- You have authority to bind that business or organization
- The information you provide is accurate
- The business or organization agrees to these Terms
- You are responsible for activity conducted through the applicable account or Shopify store
Our services are not directed to children.
2. Scope of These Terms
These Terms apply to:
- RumReef.co
- Digital downloads and digital products sold by Rum Reef
- Services sold or performed by Rum Reef
- Shopify apps developed or operated by Rum Reef
- Accounts, dashboards, files, notifications, and related features
- Support and other communications involving our products and services
A particular app, product, subscription, service, or offer may include additional terms, plan descriptions, license conditions, usage limits, or requirements.
Those product-specific terms supplement these Terms. If a product-specific term directly conflicts with these general Terms, the product-specific term will control for that product or service.
3. Shopify and Third-Party Platforms
Rum Reef is an independent Shopify app developer and service provider.
Shopify is a separate company and is not responsible for the design, operation, support, performance, or content of Rum Reef apps, digital products, or services.
Your use of Shopify remains subject to Shopify’s own terms, policies, platform rules, and technical requirements.
Certain Rum Reef services depend on Shopify, Shopify APIs, themes, browsers, hosting providers, email providers, payment processors, and other third-party systems that we do not control.
Changes, interruptions, restrictions, errors, or discontinued functionality involving a third-party platform may affect our services.
We do not guarantee that a third-party platform will remain available, maintain the same features, or continue supporting a particular integration.
4. Accounts and Account Security
Some services may require a Shopify account, connected store, login session, email address, or other account information.
You are responsible for:
- Providing accurate and current information
- Maintaining the security of your Shopify store and connected accounts
- Restricting access to authorized users
- Reviewing user permissions
- Protecting passwords, authentication methods, and devices
- Informing us promptly about suspected unauthorized access
- Activity performed through your account or store
You must not misrepresent your identity, impersonate another person or business, or access an account or store without authorization.
Rum Reef is not responsible for losses caused by unauthorized access resulting from your failure to maintain reasonable account security.
5. Shopify App Permissions and Store Data
A Rum Reef app may request access to Shopify store information and permissions reasonably necessary to provide its stated functionality.
Depending on the app, this may include:
- Store identity and contact information
- Product information
- Product images
- Variants
- Pricing
- Inventory information
- Metafields
- App settings
- Usage information
- Other store data described during installation or in product-specific documentation
You authorize Rum Reef to access, process, copy, transform, store, export, transmit, and otherwise use this information only as reasonably necessary to provide, secure, support, and improve the applicable app.
You represent that you have the right and authority to provide the information processed through the app.
Unless a product-specific notice states otherwise, our apps are not designed to access Shopify customer records, customer addresses, customer order history, or customer payment information.
You should not place unnecessary personal, confidential, regulated, or sensitive information in product fields or other store data processed by an app.
Our handling of personal information is also governed by our Privacy Policy.
6. Merchant Responsibilities
You are responsible for your Shopify store, products, product information, settings, staff access, customer relationships, legal compliance, and business operations.
You are responsible for:
- Reviewing an app’s description, permissions, pricing, and requirements before installation
- Confirming that an app is appropriate for your intended use
- Configuring the app correctly
- Reviewing files, exports, changes, and other app output
- Maintaining independent copies of important information
- Testing changes before relying on them in a live store
- Following Shopify’s rules and applicable laws
- Obtaining any notices, permissions, or consents required for your use of the app
- Ensuring that your content does not violate another person’s rights
You remain responsible for decisions made using information or output provided by our apps.
7. Backup, Export, and Data Files
Some Rum Reef apps may create backups, exports, reports, CSV files, email attachments, or other copies of store information.
Unless expressly stated otherwise:
- These files are supplemental copies and should not be your only backup
- You are responsible for downloading and retaining copies before they expire
- You are responsible for confirming that a generated file contains the information you expected
- You should inspect files before relying on them
- File availability may be limited by a stated retention period
- Restoration may require Shopify’s import tools or other manual processes
- A backup or export does not guarantee that every field can be restored exactly as it originally appeared
- Shopify changes may affect export or import compatibility
Rum Reef does not guarantee that Shopify or another platform will accept every file or restore every field.
If an app detects an error or incomplete process, you are responsible for reviewing the notice and taking any requested action.
8. Digital Products, Downloads, and Single-Store License
Digital products may include files, templates, graphics, themes, theme sections, code, software, documentation, configuration files, or other electronically delivered materials.
Delivery may occur through:
- A download page
- A download link
- An online account
- Another delivery method described before purchase
License for One Website or Shopify Store
Unless the product description expressly provides a different license, each purchase grants a limited, revocable, non-exclusive, non-transferable license to use the digital product on one website or one Shopify store.
For a Shopify product, the license is assigned to the specific Shopify store for which the product was purchased or first installed. The licensed store may be identified by its Shopify store account, store ID, or myshopify.com address.
The product may not be transferred, copied, installed, or reused on:
- A different Shopify store
- A different myshopify.com store
- An additional or separate website
- A development, staging, testing, duplicate, replacement, or temporary store
- Another business, customer, client, or organization
A separate license must be purchased for each additional website or Shopify store unless the product description expressly states otherwise.
A custom domain, regional domain, subdomain, alias, or redirect connected to the same licensed Shopify store does not require an additional license, provided it remains part of the same underlying Shopify store and is not used to operate a separate website.
Changing the public-facing domain of the licensed Shopify store does not transfer the license to another Shopify store.
Store Ownership Transfers
If the complete licensed website or Shopify store is sold or transferred to a new owner, the license may transfer with that website or store only when:
- The complete website or Shopify store is transferred
- The product remains installed or used only on the same licensed website or underlying Shopify store
- The previous owner stops using the product and deletes all copies not transferred with the store
- The new owner agrees to these Terms and any product-specific license terms
- The product is not moved to a different Shopify store, myshopify.com store, or separate website
The license cannot be separated from the licensed website or Shopify store and sold, assigned, sublicensed, or transferred independently.
The transfer of a domain name by itself does not transfer the license to a different website or Shopify store.
No Modifications Permitted
Unless Rum Reef provides express written permission for a specific product or use, you may not modify, adapt, translate, alter, edit, remove, replace, obscure, extend, combine, convert, or create derivative works from any digital product or any portion of its code or files.
This restriction includes modifications made by you or by an employee, developer, designer, contractor, consultant, agency, automated tool, artificial intelligence service, or other third party acting on your behalf.
If you or another party modifies a product despite this restriction, the modification is unauthorized and is performed entirely at your own risk.
To the fullest extent permitted by law, Rum Reef is not responsible or liable for any loss, damage, error, vulnerability, malfunction, incompatibility, data loss, service interruption, accessibility issue, performance issue, security issue, Shopify issue, third-party claim, or other consequence arising from or related to an unauthorized modification.
Unauthorized modification may immediately end your right to receive:
- Technical support
- Troubleshooting assistance
- Product updates
- Compatibility assistance
- Corrections
- Replacement files
- Refunds relating to the modified product
Rum Reef may require the removal of all unauthorized modifications and restoration of the original product before reviewing or providing support for an issue.
Modification of a product does not create any ownership, license, copyright, or other intellectual property right in the original product or any modified version containing Rum Reef materials.
Prohibited Code Use and App Development
You may not use any Rum Reef product or any portion of its source code, object code, scripts, files, templates, components, documentation, design assets, structure, or other protected materials to create, develop, train, generate, assist with, or operate:
- Another Shopify app
- A website app or plugin
- A Shopify theme or theme section
- Software as a service
- A downloadable digital product
- A commercial or noncommercial software product
- A competing or substantially similar product
- A derivative product or service
- A product intended for resale, licensing, distribution, or use by another party
You may not copy, extract, reuse, adapt, translate, port, convert, reproduce, incorporate, or otherwise use any identifiable portion of Rum Reef code or protected materials in another product.
These restrictions apply to:
- Original Rum Reef code
- Modified Rum Reef code
- Code generated from, based on, or derived from Rum Reef code
- Code rewritten, translated, reformatted, minified, compiled, decompiled, or converted into another programming language or format
- Any portion of the product used as the foundation, starting point, template, component, or reference implementation for another product
You may not provide Rum Reef code or files to an artificial intelligence system, code-generation service, development platform, contractor, or other third party for the purpose of creating, reconstructing, modifying, analyzing, or developing another app, product, or service.
You may not reverse engineer, decompile, disassemble, decode, or attempt to discover the source code, underlying structure, or non-public operation of a product, except to the limited extent that such a restriction cannot legally be enforced under applicable law.
Nothing in these Terms prevents a person from independently developing a product without copying, accessing, using, or deriving it from Rum Reef code or other protected Rum Reef materials.
Prohibited Distribution and Resale
You may not:
- Sell or resell the product
- Repackage the product for sale or distribution
- Redistribute, sublicense, publish, share, loan, rent, or give away the product
- Make the product or its files available for download or access by another party
- Include it in another product, package, membership, subscription, service, repository, or marketplace offering
- Use it to create another product for sale, licensing, distribution, or use by others
- Upload it to a public or private code repository except for a private repository used solely for the licensed store and accessible only to authorized personnel
- Claim ownership or authorship of the original product
- Remove, alter, or conceal copyright, license, attribution, trademark, or ownership notices
- Bypass or interfere with license verification, access restrictions, or other technical protections
- Permit another business or client to use the product on a different website or Shopify store
These restrictions apply to the original product and to any copy, modified version, derivative version, extracted portion, translated version, or reformatted version.
Employees and contractors may access the product only when reasonably necessary to perform work on behalf of the licensed website or Shopify store. They receive no separate license and may not retain, reuse, modify, transfer, or distribute the product for another purpose.
Customer Responsibilities
You are responsible for:
- Providing a valid email address
- Downloading files before a delivery link expires
- Retaining an authorized backup copy
- Reviewing compatibility and technical requirements
- Having suitable software, equipment, and technical knowledge
- Installing the product only on the licensed website or Shopify store
- Restricting access to authorized personnel
- Protecting files and code from unauthorized access, copying, or distribution
- Informing employees and contractors of these license restrictions
Purchasing or receiving a digital product does not transfer ownership of the product or any Rum Reef intellectual property.
All rights not expressly granted are reserved by Rum Reef.
9. Services
Rum Reef may offer technical, creative, consulting, setup, customization, development, or other services.
The description, price, scope, delivery method, and estimated schedule for a service may be stated on the product page, checkout page, written proposal, invoice, email, or other written communication.
You are responsible for providing information, files, access, approvals, and feedback reasonably required to perform the service.
Delays caused by missing information, unavailable access, late approvals, or changes requested by you may affect completion.
Work outside the stated scope may require a separate charge or agreement.
Unless expressly stated otherwise, estimated completion dates are estimates and are not guaranteed deadlines.
10. Orders and Acceptance
Submitting an order does not require Rum Reef to accept it.
We may reject, limit, or cancel an order when reasonably necessary, including because of:
- A pricing or product-description error
- Suspected fraud or unauthorized payment
- Product or service unavailability
- Technical problems
- Violation of these Terms
- Legal or regulatory restrictions
- Inability to complete the requested service
- Misuse of our website, apps, or checkout
If we cancel an order after collecting payment and no product or service has been provided, we will issue an appropriate refund to the original payment method.
11. Prices, Taxes, and Payment
Prices are displayed in the currency shown at the time of purchase or app approval.
Prices may change at any time. A price change will not retroactively alter a completed one-time purchase.
You are responsible for reviewing the total price and any recurring or usage-based charges before approving a purchase or subscription.
Applicable taxes may be calculated and collected through Shopify or another payment provider.
You are responsible for taxes, duties, registrations, reporting, or other government charges that apply to your business or use of our services, except for taxes Rum Reef is legally required to collect or pay.
Payment processing for website purchases is provided by Shopify and its payment providers. Rum Reef does not directly receive or store complete payment-card numbers.
12. Shopify App Billing
Paid Shopify apps are billed through Shopify’s billing system.
App charges may include:
- Recurring subscription charges
- One-time charges
- Usage-based charges
- Charges based on a selected plan or service level
- Other charges clearly presented before approval
By approving an app charge through Shopify, you authorize Shopify to include the applicable charge on your Shopify bill.
Recurring subscriptions continue until cancelled through the available app billing controls or by uninstalling the app as provided through Shopify.
Uninstalling or cancelling an app does not eliminate:
- Charges already incurred
- Charges already approved
- Pending usage-based charges
- Amounts covering a billing period that has already begun
- Other amounts properly owed before cancellation
Shopify controls the timing, presentation, collection, and processing of Shopify App Store charges.

13. Trials, Plans, and Usage Limits
An app may offer a free trial, free plan, paid plan, promotional period, or usage allowance.
The applicable limits and pricing will be described in the app, its Shopify App Store listing, or the billing approval screen.
At the end of a trial, access may:
- End
- Become limited
- Continue under a free plan
- Convert to a paid plan after the required approval
We will not charge a paid Shopify app subscription without the authorization required through Shopify’s billing system.
You may lose access to features or stored files when a trial, plan, subscription, or app installation ends.
You are responsible for retrieving any files or information you need before access or retention periods expire.
14. Refunds and Cancellations
Website purchases, digital downloads, digital products, services, subscriptions, cancellations, and refund requests are subject to our Refund and Cancellation Policy.
Digital products generally cannot be returned after they are delivered or made available.
Nothing in these Terms or the Refund and Cancellation Policy limits a consumer right that cannot legally be waived.
Refunds involving Shopify App Store charges may need to be approved by Rum Reef and processed through Shopify’s billing system.
15. Service Communications and Marketing
We may send communications necessary to provide or manage a product, service, purchase, account, or app.
These may include:
- App status notifications
- File delivery messages
- Backup notifications
- Error notices
- Billing notices
- Security notices
- Required actions
- Account communications
- Changes to a service
- Legal or policy notices
You may be able to disable optional notifications.
You cannot opt out of communications that are reasonably necessary to operate the service, address an account or billing issue, protect security, or meet a legal obligation while the relevant relationship remains active.
Installing an app or purchasing a product does not automatically subscribe you to promotional marketing.
Marketing communications are sent only when you separately subscribe or otherwise provide valid permission. You can unsubscribe from marketing without cancelling your app, account, or purchase.
16. Acceptable Use
You may not use Rum Reef’s website, apps, products, or services to:
- Violate any law or regulation
- Violate Shopify’s policies or platform rules
- Infringe intellectual property, privacy, publicity, or other rights
- Access a store, account, system, or information without authorization
- Introduce malware, viruses, harmful code, or destructive content
- Interfere with security, availability, or performance
- Probe, scan, or test vulnerabilities without written permission
- Circumvent access controls, usage limits, or billing systems
- Reverse engineer, decompile, disassemble, or attempt to extract source code except where the law expressly permits it
- Scrape or automatically collect information in a manner not authorized by us
- Resell, sublicense, copy, or redistribute an app or service
- Use the service to send spam or deceptive communications
- Upload illegal, fraudulent, misleading, abusive, or infringing content
- Impersonate another person or business
- Use the service in a way that creates unreasonable load or disruption
- Help another person perform any prohibited activity
We may investigate suspected misuse and restrict or terminate access where reasonably necessary.
17. Customer and Merchant Content
You retain ownership of content you provide or make available through our services.
You grant Rum Reef a limited, non-exclusive license to access, host, copy, process, modify, transmit, and display that content only as reasonably necessary to:
- Provide the requested service
- Operate the applicable app
- Generate requested files or output
- Provide support
- Maintain security
- Troubleshoot problems
- Comply with legal obligations
You represent that:
- You own the content or have permission to use it
- Providing it to Rum Reef does not violate another person’s rights
- The content and your use of it comply with applicable law
- The content does not contain prohibited or unnecessary sensitive information
This license ends when the information is deleted from our active systems, except for temporary backup copies, de-identified information, legal retention requirements, and information independently retained by Shopify or another provider.
18. Feedback
If you provide ideas, recommendations, feature requests, suggestions, or other feedback, you permit Rum Reef to use that feedback without restriction or compensation.
This does not transfer ownership of your confidential store information, personal information, or original content.
19. Intellectual Property
Rum Reef and its licensors own all rights in the website, apps, software, code, interfaces, documentation, branding, designs, text, graphics, digital products, files, and other materials provided by Rum Reef, except for customer or third-party content.
These Terms do not transfer ownership of any Rum Reef intellectual property.
Subject to these Terms and payment of applicable fees, Rum Reef grants you a limited, revocable, non-exclusive, non-transferable right to access and use the applicable app, product, or service for its intended purpose.
You may not remove or alter copyright, trademark, attribution, license, or ownership notices.
“Rum Reef” and associated names, designs, and branding may not be used in a way that suggests sponsorship, endorsement, or affiliation without written permission.
20. License Violations and Enforcement
Any unauthorized modification, copying, reproduction, installation, use, extraction, distribution, disclosure, resale, sublicensing, transfer, reverse engineering, creation of a derivative work, or use of Rum Reef materials to create another product constitutes a material violation of these Terms.
Upon a violation or reasonably suspected violation, Rum Reef may, to the fullest extent permitted by law:
- Immediately suspend or terminate the applicable license
- Suspend or terminate access to products, updates, downloads, accounts, or support
- Require the immediate cessation of all unauthorized use
- Require the removal of the product from unauthorized websites, stores, apps, services, repositories, marketplaces, or systems
- Require the permanent deletion or destruction of unauthorized copies, modifications, derivative works, and distributed files
- Require written confirmation that the prohibited materials have been removed and destroyed
- Issue removal or takedown requests to hosting providers, platforms, marketplaces, search providers, payment providers, or other intermediaries
- Seek temporary, preliminary, or permanent injunctive or equitable relief
- Seek recovery of actual damages
- Seek recovery of profits attributable to the violation
- Seek statutory damages where available
- Seek recovery of reasonable costs and attorneys’ fees where permitted
- Pursue contractual, copyright, trademark, unfair competition, misappropriation, or other available legal claims
- Exercise any other remedy available under these Terms or applicable law
Termination of the license does not authorize continued possession or use of the product.
After termination, you must immediately stop using the product and delete or destroy all copies within your possession or control, except for copies that applicable law requires you to retain.
The remedies described in this section are cumulative and are not the exclusive remedies available to Rum Reef.
A delay or failure by Rum Reef to enforce a violation does not waive the violation or prevent later enforcement.
You are responsible for violations committed by employees, contractors, developers, agencies, consultants, or other parties to whom you provide access to the product.
Nothing in these Terms creates a predetermined award or guarantees that a court or other authority will grant a particular remedy. Any remedy remains subject to applicable law and the facts of the matter.
21. Third-Party Content and Services
Our website, apps, products, or communications may contain links to or integrate with third-party services.
Rum Reef does not control and is not responsible for third-party:
- Websites
- Software
- Platforms
- Apps
- Content
- Privacy practices
- Security
- Availability
- Terms
- Charges
- Changes or discontinuation
Your use of a third-party service is governed by that provider’s terms and policies.
A link or integration does not necessarily mean Rum Reef endorses or guarantees the third party.
22. Availability, Maintenance, and Changes
We work to keep our website, apps, and services operational, but continuous availability is not guaranteed.
Access may be interrupted because of:
- Maintenance
- Software updates
- Security concerns
- Hosting or infrastructure failures
- Shopify or API changes
- Third-party outages
- Internet or network failures
- Legal requirements
- Events outside our reasonable control
We may update, replace, modify, limit, or discontinue features when reasonably necessary for:
- Security
- Legal compliance
- Compatibility
- Reliability
- Performance
- Product development
- Third-party platform changes
- Preventing abuse
- Improving the service
When required by applicable law, we will provide notice of material changes and any legally required remedies.
No service-level agreement applies unless Rum Reef expressly agrees to one in a separate written agreement.
23. Support
Support is available through the contact methods provided on RumReef.co, within the app, or in the Shopify App Store listing.
Support availability, response times, and supported issues may vary by product or plan.
We do not guarantee an immediate response or a specific resolution time unless a separate written service agreement states otherwise.
We may require information reasonably necessary to investigate an issue, including:
- Store domain
- Error messages
- Screenshots
- Relevant settings
- Steps that produced the problem
- Browser and device information
- Temporary access provided through Shopify-approved methods
You should not send passwords, complete payment-card information, or unnecessary sensitive information.
24. Suspension and Termination
You may stop using our website, products, or services at any time.
You may uninstall a Shopify app through your Shopify admin.
We may suspend or terminate access when reasonably necessary because of:
- Violation of these Terms
- Nonpayment
- Fraud or suspected fraud
- Security threats
- Abuse
- Unauthorized access
- Legal requirements
- Harm to Rum Reef, Shopify, another user, or a third party
- Discontinuation of a product or service
Where appropriate, we may provide notice and an opportunity to correct the issue before termination.
Immediate suspension or termination may occur when necessary to prevent harm, address unlawful activity, protect security, or comply with a legal requirement.
Termination does not eliminate obligations or charges that arose before termination.
Sections that by their nature should continue after termination will remain effective, including sections involving payment, intellectual property, license restrictions, enforcement, disclaimers, liability, indemnification, disputes, and retained records.
25. Privacy
Our Privacy Policy explains how we collect, use, disclose, and retain personal information.
By using our services, you acknowledge that personal information will be processed as described in that policy.
When Rum Reef processes personal information on behalf of a Shopify merchant, additional data-processing terms may apply where required by law.
26. No Professional Advice
Information provided through Rum Reef’s website, apps, digital products, documentation, or support is for general operational and informational purposes.
Unless a separate written agreement expressly states otherwise, Rum Reef does not provide legal, tax, accounting, financial, medical, or other licensed professional advice.
You are responsible for obtaining appropriate professional advice for your specific situation.
27. Disclaimer of Warranties
To the fullest extent permitted by law, Rum Reef’s website, apps, products, files, and services are provided “as is” and “as available.”
Rum Reef does not guarantee that:
- A service will always be available or uninterrupted
- A service will be free from every error or vulnerability
- Every file or export will contain every possible field
- A file will be compatible with every version of Shopify or third-party software
- Shopify will import or restore every item exactly
- A service will meet every individual business requirement
- Every error can be corrected
- Results will produce a particular financial, operational, or commercial outcome
- Third-party services will remain available or unchanged
We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement to the extent those disclaimers are legally permitted.
Nothing in this section excludes a warranty or consumer right that cannot legally be excluded.
28. Limitation of Liability
To the fullest extent permitted by law, Rum Reef will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including:
- Lost profits
- Lost revenue
- Lost sales
- Lost business opportunities
- Lost goodwill
- Business interruption
- Loss or corruption of data
- Costs of obtaining substitute services
- Claims arising from third-party platforms or services
To the fullest extent permitted by law, Rum Reef’s total liability arising from or related to a product, app, service, or these Terms will not exceed the greater of:
- The amount you paid Rum Reef for the applicable product or service during the 12 months before the event giving rise to the claim
- One hundred US dollars
These limitations apply regardless of the legal theory asserted and even if Rum Reef was advised that damages were possible.
These limitations do not apply where liability cannot legally be excluded or limited, including any applicable rights involving fraud, intentional misconduct, personal injury, or mandatory consumer protection.
29. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Rum Reef and its operator, contractors, service providers, and representatives from third-party claims, liabilities, damages, losses, and reasonable expenses arising from:
- Your violation of these Terms
- Your unlawful or unauthorized use of a service
- Your Shopify store, products, or content
- Your infringement of another person’s rights
- Information or content you provide
- Your violation of applicable law
- Your misuse of an app, file, product, or service
- Your unauthorized copying, modification, distribution, resale, transfer, or use of Rum Reef materials
This section does not require a consumer to indemnify Rum Reef where such a requirement is prohibited by applicable law.
30. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles.
Subject to any mandatory rights that apply where you live, legal proceedings arising from these Terms or our services must be brought in a state or federal court with jurisdiction over Pinellas County, Florida.
Before filing a legal claim, you agree to contact Support@RumReef.co and make a reasonable effort to resolve the dispute informally.
Nothing in this section prevents either party from:
- Seeking emergency or injunctive relief
- Filing a claim in an eligible small claims court
- Exercising a right that cannot legally be waived
- Filing a complaint with a regulatory or consumer-protection authority
If you are a consumer, this section does not remove any mandatory protection or right to bring a claim in a court available to you under the laws of your country or region.
31. European Consumer Rights
If you are a consumer in the European Union, European Economic Area, United Kingdom, Switzerland, or another jurisdiction with mandatory consumer protections, those protections continue to apply.
Nothing in these Terms limits rights that cannot legally be waived, including applicable rights involving:
- Pre-purchase information
- Digital content or service conformity
- Defective digital products
- Contract cancellation or withdrawal
- Refunds or price reductions
- Service modifications
- Legal guarantees
- Access to courts or consumer authorities
The loss of a cooling-off or withdrawal right for immediate digital content requires any consent and acknowledgment required by applicable law.

32. Electronic Communications
You agree that agreements, notices, invoices, disclosures, confirmations, and other communications may be provided electronically, including through:
- The website
- An app interface
- Shopify
- A customer account
- A download or confirmation page
You are responsible for maintaining an accurate email address and reviewing communications related to your account, purchases, or apps.
Electronic communications satisfy any legal requirement that a communication be in writing to the extent permitted by law.
33. Changes to These Terms
We may update these Terms to reflect changes involving:
- Our products or services
- Shopify or third-party platforms
- Security
- Technology
- Business operations
- Legal or regulatory requirements
The updated Terms will be posted with a revised “Last updated” date.
Changes generally apply prospectively from their effective date.
Where required by law, we will provide additional notice before a material change takes effect.
Continued use after an updated version becomes effective constitutes acceptance where permitted by law. If you do not accept an update, you must stop using the affected service and cancel any ongoing subscription.
34. Assignment
You may not transfer or assign your rights or obligations under these Terms without our written consent, except for a permitted transfer of a licensed website or Shopify store under Section 8.
Rum Reef may assign these Terms as part of an incorporation, reorganization, merger, acquisition, asset transfer, financing, or sale of the business, subject to applicable law.
35. Force Majeure
Rum Reef is not responsible for delay or failure caused by events outside our reasonable control, including:
- Natural disasters
- Severe weather
- Fire
- War
- Terrorism
- Civil unrest
- Labor disruptions
- Government actions
- Internet or utility failures
- Cyberattacks
- Hosting failures
- Shopify outages
- Third-party platform failures
- Public health emergencies
This section does not excuse payment obligations that arose before the event or limit rights that cannot legally be waived.
36. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect.
The invalid provision will be interpreted or modified only to the minimum extent necessary to make it enforceable where permitted.
37. No Waiver
A failure to enforce a provision of these Terms does not waive the right to enforce it later.
A waiver is effective only if it is provided in writing by Rum Reef.
38. Entire Agreement
These Terms, together with the Privacy Policy, Refund and Cancellation Policy, applicable product descriptions, approved Shopify billing terms, and any product-specific written terms, form the entire agreement between you and Rum Reef concerning the applicable product or service.
They replace prior discussions or representations about that subject, except for a separate written agreement signed by Rum Reef.
